Terms and Conditions:

By ordering any service from QuickPicTours.com, either online, over the phone, or in person you agree to the Terms and Conditions outlined below, including the refund policy, as well as the Privacy Policy.

Fulfillment of Services:
Once an order is placed, QuickPicTours.com agrees to arrange and schedule a photoshoot for any of the services offered. Contact will be made on the same business day that the order was placed with the individual indicated on the order for contact; if placed on a holiday or on a day that is not a business day, contact will be made the following business day. An appointment will then be scheduled for the photoshoot with one of our independent contractor photographers. QuickPicTours.com agrees to provide the results of the photoshoot within 48 hours from the date of the shoot.

Ownership:
It is expressly understood that the work product from any photoshoot or 3D Walk-through Tour (i.e. Matterport Tour) is owned by QuickPicTours LLC. QuickPicTours LLC grants a temporary license of usage for temporary display of such work product, both publicly and privately, as deemed necessary by the client. Such license is granted for a period of time as deemed reasonable by QuickPicTours LLC, and shall expire immediately upon either verbal or written notice to client. As it pertains to a real estate listing, it is implied that such license shall remain active as long as the real property for sale for which the work product was completed is actively marketed for sale.

The work product provided shall not be sold, leased, or otherwise redistributed for commercial gain without the prior written consent of QuickPicTours LLC.

Rescheduling/Cancellation Fees:
You agree, with no exception, to pay a $25 rescheduling or cancellation fee if you must cancel or reschedule your photoshoot within less than 24 hours from the time of the shoot. Such fee is to offset the hard cost of rescheduling the shoot and the time and travel expense of our photographers.

Fulfillment and Delivery: We agree to fulfill you order and deliver your digital files no later than 48 hrs from the day of the shoot and 24 hrs from the day of the shoot for rush orders to your email specified in the details of the order. Delivery time may be at any hour within the day.

Travel & Miscellaneous Fees:
You agree to pay any and all travel fees associated with your photoshoot. Travel fees are calculated on a per mile cost for approximate distance traveled for our independent contractor photographers.

As it pertains to Matterport 3D Tours, QuickPicTours agrees to host any particular Matterport tour for the period of 1 year from the completion and delivery date, after which time the tour will become inactive and no longer publicly available. The client may choose prior to the date of deactivation to pay $50 for an additional year of hosting. If the client fails to pay the $50 annual activation fee prior to the date of deactivation QuickPicTours makes no guarantee that the Matterport 3D tour may be recovered. If QuickPicTours is unable to recover the tour, the client will have to order a new Matterport tour.

REFUND POLICY & Dispute Resolution:
If the digital content provided is unsatisfactory, please contact support at support@quickpictours.com or call our toll-free number (888) 733-3353 to arrange a new photoshoot, re-editing of any digital content, or to express any other concerns or complaints you may have. QuickPicTours may at is sole discretion decide to reshoot, re-edit, provide a refund in part or full,  or to deny any of the services we offer. However, our goal is to satisfy our customers to the best our ability. On a case-to-case basis we will evaluate the request being made.

HOLD HARMLESS - To the fullest extent permitted by law, you as well as any real property owner/seller, tenant, or anyone else with whom you are affiliated, agree to defend (including attorney’s fees), pay on behalf of, indemnify, and hold harmless QuickPicTours, its elected and appointed officials, employees, volunteers, hired independent contractors and any other individual or entity working on behalf of QuickPicTours against any and all claims, demands, suits or loss, including all costs connected therewith, and for any damages which may be asserted, claimed or recovered against or from QuickPicTours, its elected and appointed officials, employees, volunteers, hired independent contractors or any others working on behalf of QuickPicTours.

Whether as a real estate broker or agent, real property owner/seller, client, customer, etc.,  you are solely liable for all the personal property in, around or on any real property of any listing during a QuickPicTours photoshoot.

Privacy Policy:

SECTION 1 - WHAT DO WE DO WITH YOUR INFORMATION?

When you purchase something from our online store, or we manually gather your information, we collect the personal information you give us such as your credit/debit card information, name, address, phone and email address.

When you browse our store, we also automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system; which also collects location data.

We retain only contact information in our Client Relations Management (CRM) system in order to facilitate clear communication with you. Location data may be retained within our website. Any and all financial data including but not limited to credit/debit card data is NOT RETAINED by QuickPicTours. However, with your consent, either verbal or written, your financial information may be stored by Simply Commerce (a Master Card Company) to process future orders or to process other fees such as travel, rescheduling, or cancellation fees without having to re-collect credit/debit info. Simplify Commerce is the payment gateway currently in use by QuickPicTours and may be subject to change at any given time with or without notice.

SECTION 2 - CONSENT

How do you get my consent?

When you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a refund or return a purchase, we imply that you consent to our collecting it and using it for that specific reason only.

If we ask for your personal information for a secondary reason, like marketing, we will either ask you directly for your expressed consent, or provide you with an opportunity to say no. However, you consent and opt-in to marketing campaigns by simply placing an order with us even if you have opted-out previously.

How do I withdraw my consent?

If after you opt-in, you change your mind, you may withdraw your consent for us to contact you, for the continued collection, use or disclosure of your information, at anytime, by contacting us at support@quickpictours.com, calling our toll-free number at (888) 733-3353 or mailing us at:

SECTION 3 - DISCLOSURE

We may disclose your personal information if we are required by law to do so or if you violate our Terms and Conditions.

SECTION 4 - Data Storage

Our store is hosted on a shared hosting platform. Your data is stored through our hosting service's data storage, databases and the general application. We store your data securely on our shared hosting platform with 256-bit SSL encryption.

Payment:

If you choose a direct payment gateway to complete your purchase, then QuickPicTours.com does not stores your credit card data. Currently QuickPicTours uses Simplify Commerce as its direct payment gateway.

If you provide your credit/debit card info over the phone we are allowed to store your data only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted; unless you desire to be an ongoing client whereupon we will add you as a client with your secure data on our Simplify Commerce database of clients. Only verbal consent is needed.  By agreeing to these terms and conditions you are providing that consent.

All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover.

PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

HOLD HARMLESS - If you verbally consent to the storage of your financial or personal data via our payment gateway you accept any and all liability pertaining to the storage of such data and will hold QuickPicTours LLC harmless; even if there is a breach and release of personal information by such payment gateway.

SECTION 5 - THIRD-PARTY SERVICES

In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.

However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.

For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers.

In particular, remember that certain providers may be located in or have facilities that are located a different jurisdiction than either you or us. So if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.

As an example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, then your personal information used in completing that transaction may be subject to disclosure under United States legislation, including the Patriot Act.

Once you leave our store’s website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms and Conditions.

When you click on links on our store, they may direct you away from our site. We are not responsible for the privacy practices of other sites and encourage you to read their privacy statements.

SECTION 6 - SECURITY

To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.

If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with a AES-256 encryption.  Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards to protect your information.

You understand and consent to the use of cookies or future possible use of cookies.

SECTION 8 - AGE OF CONSENT

By using this site, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

SECTION 9 - CHANGES TO THIS PRIVACY POLICY

We reserve the right to modify this privacy policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the website. If we make material changes to this policy, we may notify you here that it has been updated, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it. However, it is your sole responsibility to be aware of any material change(s) made in these terms and conditions and privacy policies.

If our store is acquired or merged with another company, your information may be transferred to the new owners so that we may continue to sell products to you.
